Judge Dismisses Federal Suit Against MSHA

Charleston, WV (HNN) - A federal judge Friday afternoon, May 21, dismissed a suit filed by the estates of two miners killed in the Upper Big Branch mine disaster. Along with the United Mine Workers, the complaint requested that interviews conducted by the Mine Safety Health Administration not be private.
 
Attorney wanted an injunction to require that a representative of the surviving miners and /or the UMW to be present during all interviews.
 
However, the judge sided with the defendant ruling that the suit was essentially against the United States and therefore the mine agency's claim of sovereign immunity deprived the court of jurisdiction to rule on the complaint.
