WVGOP Chairman Says “Risk Too Great Not To Challenge Ballot”

Charleston, WV (HNN) - The West Virginia Republican Party intends to file suit at 2 p.m. today in the Circuit Court of Kanawha County to challenge the form of the ballot for the November 2, 2010, general election and special election.
 
“We had hoped that this action would not be necessary and that the Secretary of State would have taken action to correct the problems with the ballot for the two separate elections to occur on November 2nd,” Stuart stated. “Unfortunately, no remedial action has been taken and we are left with no alternative but to seek input from the courts. WV Code is absolutely clear in stating that the special election for United States Senate shall be a separate election from the general election but yet Secretary Tenant decided otherwise.”
 
Stuart continued, “Despite numerous inquiries of concern from Democrats and Republicans throughout West Virginia, Secretary of State Tenant decided arbitrarily to ignore those legitimate concerns in favor of a more risky approach – printing a single ballot for two elections and providing only a single straight ticket option that is supposed to count for both elections. West Virginians must have confidence that the ballot on November 2nd will withstand all scrutiny. The public has a fundamental interest in ensuring that elections are lawfully conducted in the first instance so as to avoid unnecessary challenges to the election results.”
 
“Unlike any other state in the nation, John Raese or Joe Manchin will, upon election, be seated immediately in Congress. Given the risks of a lame duck Congress and the potential for the Obama Administration to ram down our throats damaging job-killing, budget busting legislation in the final days of this Congress, we cannot afford any delay in seating our Senator due to possible litigation concerning the ballot or election law mistakes on the party of Natalie Tenant. Regardless of party, this suit is essential to protect the interest of all West Virginians,” concluded Stuart.
