Huntington, WV (HNN) - Three high profile trials have already been assigned to the first months of 2011, according to recent Cabell County Circuit Court dockets.
Joshua Clark, the alleged accomplice in a series of robberies of Marquee Cinemas Pullman Square, will stand trial February 8. That date was set following a motion hearing that occurred Wednesday, Dec. 15.
Clark, a former theatre employee has maintained his innocence, but Dustin Shaver has signed a plea agreement to testify against Clark. Shaver was the man who tied up several theatre employees in the office and held them at gun point.
Motions to suppress search warrants and phone records have been denied by Judge Alfred Ferguson.
BOWEN
Senior Status Judge John Cummings set February 8 as the new date for former Huntington police captain Foster “Pete” Bowen to stand trial on multiple sexual molestation charges. The 80-year-old man has been indicted on 24 sexual assault counts and 14 counts of sexual abuse. Eight alleged victims have come forward. The acts allegedly occurred between 1981 and 2003. Bowen’s attorney objected to the one month trial delay. Bowen remains jailed on a one million dollar bond.
GOOD
The trial of Donald Good could begin in March 29, 2011. He’s the inmate at the Mount Olive Correctional Center charged with two rapes that occurred in January and February 1987 at the Huntington Mall.
Prosecutors contend that Good’s DNA matches previously unidentified DNA samples. Originally, Glen Dale Woodall was tried and convicted of the crimes. However, evidence later exonerated him.
