WV Supreme Court Turns Player Eligibility Back to SSAC

Charleston, WV (HNN) – Reminiscent of the Charleston ruckus concerning HHS star O.J. Mayo, the West Virginia Supreme Court has tossed the Kanawha Circuit Court injunctions. Instead, the state’s highest court leaves future eligibility decisions solely with the Secondary School Activities Commission.
 
Having the AAA championship postponed a week due to legal actions, now, the SSAC must determine whether South Charleston must forfeit its semifinal win. The Kanawha Court judge had allowed the four players involved in a Nov. 19 fight in a game with Hurricane to play in the semi-finals and AAA championship.
 
“The judiciary has no authority to review whether the rules governing the WV SSAC were properly applied… this court has long recognized that the Legislature intended the WVSSAC to promulgate rules to carry out its control, supervision and regulation of interscholastic athletic events and that courts should not interfere…” (citing Mayo v. SSAC in which the high court said it would be “unwise to proceed down the path [of] inviting court to review an official’s judgment.)
