Theatre Robbery Suspect Appears Headed for December Trial

Huntington, WV (HNN) – A former employee of Marquee Cinemas at Pullman Square likely will stand trial on robbery and conspiracy charges. Joshawa Clark, one of the suspects, seems to have rejected a plea bargain and has maintained his innocence.
On September 30, Clark was given a week to accept a plea deal or go to trial on October 20.
Dustin Shaver has already pleaded guilty to two counts of robbery with a firearm. Part of the agreement requires that he testify against Clark.
Judge Alfred Ferguson set a December 15, 2010 trial date.
According to WSAZ.com, Clark lost an attempt to suppress phone records, which indicate that minutes after one of the robberies he made contact with Shaver. The two men have been friends throughout their lives.
Clark is accused of being an inside accessory who provided Shaver with specific details..
Three robberies occurred at the theatre --- one in November 2008 and two in 2009 on July 13 and Oct. 19.
Although the suspects have been charged in the 2009 robberies, each of the robberies had some similarities i.e. the armed gunman allegedly brought a ticket, watched at least a portion of the last movie of the evening, then, demanded to be taken to the office.
Clark was originally charged as an accessory to the crime; however, the plea agreement would require that he plead guilty to one count of robbery and one count of conspiracy. If not accepted, he would stand trial on all counts of the indictment which include two counts of first degree robbery, kidnapping and conspiracy.
