Plea Bargain Offered to Former Marquee Employee
Gunman Opts for Guilty Plea Deal

Huntington, WV (HNN) – One man has pleaded guilty and the other has a week to decide on a plea bargain --- or go to trial. Both have been indicted in connection with a series of robberies in 2009 at Marquee Cinemas Pullman Square.
Dustin Shaver pled guilty to two counts of armed robbery. A kidnapping and a conspiracy charge were dropped. Shaver must also testify against alleged accomplice and former theatre employee, Joshawa Clark. Shaver will be sentenced November 3.
Clark has been offered, but has not accepted, a plea agreement He has been asked to plead guilty to one count of robbery and one count of conspiracy. If he declines the plea agreement, his trial will start October 20. The indictment charges him with two counts of robbery, conspiracy and kidnapping.
Previously, his attorney had argued that he should only be charged as an accessory after the fact.
Clark had earlier been released from home confinement because he could not afford the cost of the equipment with a minimum wage restaurant job.
Three Robberies took place near closing at the Pullman Square Marquee Cinemas over an eleven month period from November 2008 to October 2009. Surveillance video from inside the theatre helped identify the two suspects. The two men were charged in connection with the July 13 and Oct. 19, 2009 robberies.
Shaver allegedly tied up several employees in the theatre office during the October 2009 robbery. Prior to the robbery he bought a ticket, watched a movie, and after the auditorium cleared demanded an usher take him to the office, according to the October 2009 HPD news conference.
No one has been charged in connection with a November 2008 robbery at the theater.
During the unsolved November 2008 robbery, the suspect pointed a small barreled weapon at the head of a manager and demanded money from the safe. Law enforcement at that time indicated the suspect fled on foot.
[The November 2008 suspect allegedly wore a black surgical mask and goggles over a brown hooded shirt and was described as between five foot seven and five foot eight inches tall. Dogs found footprints in and around the parking garage, but lost the scent.]
Security measures at the theater were increased following the first robbery.
