309 Lincoln Absentee Ballots Tossed; Brumfield Wins

Huntington, WV (HNN) – After four hours of negotiation to avoid a weeklong trial, attorneys in Lincoln County have agreed to a settlement in the absentee voting case.
 
At the time of the primary, 800 absentee ballots were requested in the county; about 620 were cast --- the most of any county in WV. At one point in the controversy, statements were made that some of the deceased had risen to cast a ballot. Of absentee ballots cast, Bowman received 511 votes.
 
Raleigh County Judge H.L. Kirkpatrick III declared incumbent Circuit Clerk Charles Brumfield the winner in the race against Jerry Bowman, now a deputy sheriff.
 
Harvey Peyton, Brumfield’s attorney, told reporters than approximately one-third of the absentee ballots were partly or completely filled out by someone else than the absentee voter.
 
Originally, Phoebe Harless had contested the Lincoln County Commissioner race, but the judge declared her ineligible as at the time of election lived in the same magisterial district as her incumbent opponent.
