State Home Rule Board Attorney Differs to City Charter/Code on Election Petition

Huntington, WV (HNN) - Huntington has enacted a tax reform plan, but the battle has only just started.
Currently, Huntington city charter co-writer Tom McCalister and other have started a petition to put the occupation tax on the ballot.
Asked about procedural correctness of an initiative to force a special election to vote on the occupation tax, city attorney Scott McClure gave a spontaneous, just after the council meeting opinion that questioned whether the rules of the pilot Home Rule program might trump others.
HNN asked Floyd M. Sayre, III, a member of the state Home Rule board which must approve Huntington’s amendments about the voting initiative.
“The Home Rule statute does NOT contemplate the amending of the City Charter or Code. It only addresses potential changes to State Code,” Sayre wrote.
He declined to render a Huntington specific answer as he is “not familiar with Huntington’s city code.”
