Huntington User Fee Repeal Located in 37 Page Occupation Tax Ordinance

Huntington, WV (HNN) – The repeal of the city user/service fee IS contained in the 37 page occupation tax ordinance, Brandi Jacobs Jones, director of administration and finance, confirmed to HNN today via email.
 
Ms. Jacobs-Jones said the repeal is labeled as “Repeal of Article 772 as Amended” which is 774.37 of the Occupation Tax Ordinance.
 
The repeal portion reads as follows:
 
774.37 Repeal of Article 772 as Amended
 
The city service law adopted by Article 772, as amended, and as it has been amended is hereby repealed as of October 1, 2010, the date upon which this occupation tax becomes effective in the City; provided, however, that neither any cause of action nor fine, forfeiture judgment, penalty, writ, remedy or defense, accrued at said date, nor any prosecution, or complaint pending at said date shall be in any manner released, affected, abated, or impaired, by this Ordinance. Should the effective date of the occupation tax imposed by this Ordinance be postponed beyond October 1, 2010 due to the issuance of an injunction or other court order, then Article 772 shall remain effective and shall not be repealed until the date that the occupation tax does become effective.
 
Since the repeal is contained in the ordinance, no additional reading or a separate ordinance would be necessary to implement the repeal.
 
The occupation tax and other portions of the reform package will be voted on at the Monday, Aug 9 meeting at 7:30 p.m. in council chambers. A tax protest will be held at 7 p.m. at City Hall.
