Celebrity Comedian's Case Bound Over to Cabell County Grand Jury

Huntington, WV (HNN) - A celebrity and his attorney appeared in Cabell County Magistrate Court Tuesday morning, June 29. Comedian Andy Dick, who is accused of sexually assaulting two victims at the nightclub, Rum Runners, attended the preliminary hearing along with his attorney Mark Geragos, who defended Michael Jackson on sexual abuse charges.
 
Geragos currently also represents musician Chris Brown who pled guilty of felony assault of ex-girlfriend Rihanna. He assisted David Carradine's family during the death investigation, defended convicted murderer Scott Peterson, and represents two brothers injured after a tiger escaped from the San Francisco zoo.
 
The charges against Dick occurred when he visited Huntington for an appearance at the now closed Funny Bone Comedy Club. After the show, he and the Funny Bone manager went to Rum Runners, which is about a block away on Third Avenue.
 
The victims --- a bouncer and a bar patron --- have alleged that Dick groped them in the crotch.
 
Geragos argued that the alleged actions of his client do not meet the elements of the first degree sexual assault charge. In addition, under cross examination, he exposed under victim cross examination a broader scope of the night's events than previously reported or contained in the criminal complaint against the comedian.
 
According to a Herald Dispatch report, the bouncer admitted that women frequently touch and groping men at Rum Runners. Geragos inquired, "you didn't mind that?" The bouncer responded no.
 
"If he was Andria Dick, that would have been OK?" Geragos said.
 
The incidents also allegedly occurred while Dick posed with one of the victim's girl friend.
 
Despite the inconsistencies exposed by Geragos, magistrate Johnny McCallister found probable cause and bound the case over to the grand jury. The earliest meeting of the grand jury would be in July.
 
Although the comedian did not speak, Geragos was quoted as stating after the hearing, " can only hope they put the witnesses in front of the Grand Jury."
 
When he was placed under arrest, the incident attracted a large number of police officers to the club. Dick spent a short time at the Western Regional Jail before the Funny Bone manager went his bond.
 
Sean Hammers, an assistant prosecuting attorney, argued the Dick case; however prosecutor Chris Chiles was nearby and gave him advice.
