Massey Takes on MSHA
Files Suit in D.C. Federal Court Alleging Mine Ventilation Issues

Washington, DC (HNN) – Massey Energy has fired a shot at the Mine Safety and Health Administration over mine ventilation and mine equipment scrubbers.
A spokesman for Massey stated it is not related to the Upper Big Branch tragedy, but “more general,” according to Massey general counsel Shane Harvey.
Six Massey entities are plaintiffs; three top MSHA official are defendants.
"We didn't take this step lightly," Harvey said. "Obviously we would prefer not to sue the agency that regulates our operations, however, we feel we owe it to our miners to resolve this problem and we hope to do so as civilly as possible."
