Huntington, WV (HNN) – The actor who brought the tenacity and compassion of Coach Jack Lengyl to the screen has a little issue with a Malibu beach photographer. Neither one has scored a touchdown or been flagged for “roughing the celeb,” but the misdemeanor case entered another time out.

McConaughey known for surfing has apparently become slightly contentious about who snaps him without a shirt.

Having since married and became a dad, the golden skinned McConaughey has a stake in this beach rumble as a possible signal caller. When a shutter bug attempted to snap his pic, two surfers allegedly defended the sand resulting in battery charges for attacking the man and sending his camera out on a wave.

A jury deadlocked in what became the second mistrial. Back in March, the mother of one of the accused suffered injuries in a car accident. Now, the court date has been reset for July 2.

McConaughey filed a portion of “We Are Marshall” in and around Huntington in 2006. The method actor displayed a bit of his ‘I’m in character, don’t bother me” style, by telling Governor Joe Manchin to wait a few before making him an honorary West Virginian.
