Huntington, WV (HNN) – A Huntington police officer --- identified for the first time as 32-year-old Ronnie Lusk --- had been exonerated of his role in the shooting death of Joe Porter.

The shooting occurred in November 2009 at the club on Fourth Avenue. The business closed and turned in its liquor license following the incident.

According to the grand jury findings, police officers entered the club after shots were fired inside. Officers entering the club shouted for individuals to put their hands up. Based on the report, Porter , who had a silver .45 caliber gun in his hand, refused to comply. Instead, he raised his arm, prompting an officer to fire. The bullet struck Porter in the arm and enter his chest. Ballistics testing later showed that Porter had not fired the weapon.

Due to the intense public and media scrutiny of the case, the Grand Jury findings have been made available. You can download a PDF of those findings by clicking HERE.

Outside agencies, including Alcohol Tobacco and Firearms and the FBI, participated in the review of the investigation.
