Judge Pancake Clears Hurdle for Consolidated Middle School
Plaintiffs Ponder Appeal

Huntington, WV (HNN) – After sorting through volumes of historical fiscal data and other prior sworn testimony, Cabell County Circuit Judge has ruled that taxpayers do not have to vote on the University Heights construction site for a consolidated middle school.
 
A group of taxpayers had argued that the Cabell Board of Education utilized at least a portion of 1990 bond funds in the land purchase. Voters in that levy specified that the consolidated middle schools would be at the former Huntington High and Huntington East sites. When the consolidated HHS site had to be moved from what is now Kinetic Park to the school’s location across the road and south of KP, a Cabell judge mandated that the voters approve the new location.
 
However, the decision today, March 9, did not favor tax payers who had cited the prior case for requiring an election on the consolidated site of Enslow Middle and Beverly Hills Middle Schools.
 
“Until the law is changed and we can vote for a bond issue and be sure our taxes will go toward what we vote for, we should not vote for bond issues, “ said plaintiff Karen Nance.
